ACCEPTANCE OF GENERAL TERMS

We are the owners and operators of our website, including all its subpages, through which we provide visitors and customers with information about our activities, products, and services, as well as enable the use of certain functionalities of our website, and facilitate the purchase of our products through the online store.
To avoid any doubt, the mentioned subpages do not refer to the pages we may link to on our website. Namely, VH is not the owner and does not manage the websites to which we may refer through special links.

These General Terms represent the entire and legally binding agreement between you as a visitor/buyer on the website and us as the owner/seller of the website, regarding your visit and use of the website. Waiving any provision of the General Terms or the General Terms in their entirety is not permitted.

Also, as a customer in our online store, you are hereby considered informed about all important features of the purchase, and you should regard this as a pre-contractual notice in accordance with the applicable regulations governing consumer protection rules (information about the seller, main characteristics of the products, terms and methods of ordering products, product prices, payment and delivery of products, product quality, complaints and returns of products, and other matters related to the online store as defined by the applicable regulations governing consumer protection rules). These General Terms, as well as all matters not regulated by these General Terms, are governed by the law of the Republic of Croatia and the law of the European Union, to the extent that it is applicable, taking into account the membership of the Republic of Croatia in the European Union.

No oral explanation or information provided by you or anyone on your behalf to VH, and vice versa, affects the meaning or interpretation of the provisions of the General Terms, nor does it constitute a new contract / new pre-contractual notice between you and VH, an addition or amendment to the General Terms, or any guarantee.

Please read the General Terms and Conditions carefully before accessing and using the website, or before making a purchase in the online store.
By accessing and using the website, regardless of the method of access, you are deemed to have fully read and understood the General Terms and Conditions, to be fully acquainted with and agree to the General Terms and Conditions, and to use the website in accordance with them.

We reserve the right to change these General Terms at any time, for any reason, with or without prior notice. Such changes do not affect rights and obligations that arose prior to such changes. By continuing to access and use the website after the publication of the amended Terms and Conditions, you signify that you have fully read and understood them, and that you are familiar with and agree to them when further accessing and using the website. Through these General Terms, VH provides you with a revocable, limited, non-exclusive, and non-transferable permission to use the website and its content and functionalities, provided that you continuously comply with these General Terms. Prohibited behaviors when accessing and using the website include, but are not limited to:

participating in activities that are illegal, harmful, threatening, violent, infringing or jeopardizing the rights and privacy of others, or otherwise contentious,
publishing, transmitting, sending, exchanging, and any other use of materials and content that are illegal, harmful, offensive, vulgar, defamatory, infringing or jeopardizing the rights and privacy of others, or otherwise contentious,

DISCLAIMER OF WARRANTIES AND LIABILITY AND INDEMNIFICATION

The website and its content are provided to you “as is” and “as available.” VH and all related third parties with VH, to the fullest extent permitted by law, disclaim all warranties, whether expressed or implied, statutory or otherwise, including, but not limited to, implied warranties of merchantability, non-infringement of third-party rights, and fitness for a particular purpose.

Without limiting the above, VH and its associated third parties DO NOT MAKE ANY STATEMENTS OR WARRANTIES regarding the following:

that the website or its content is available or appropriate for use at locations outside the Republic of Croatia,
that the use of the website and its content, as well as the availability and use of all functionalities of the website, will be uninterrupted, error-free, and secure,
the confidentiality and secrecy of communication, or information, data, or materials transmitted to or from the website via the internet or any other form of global communication network,
that all information, data, and materials provided on the website are accurate, reliable, and complete,
that any disruptions or deficiencies related to the website will be corrected or removed,
that any software, service, location, server, or electronic communication on which the website is hosted or with which it is connected is in any way free of viruses or other harmful components,

Any obligation to indemnify in relation to the General Terms is perpetual, separate, and independent of other indemnities and continues to apply even after the expiration of these General Terms in whole or in part, or the cessation of your use of the website.

CONDITIONS FOR PURCHASING IN THE ONLINE STORE

An integral part of the website is the online store through which you can purchase our products. Purchases through the online store can currently be made in the European Union. In the case of an order that needs to be delivered outside the European Union, please contact the following email address: info@oromo.eu.

Registration

Currently, no form of registration is necessary in our online store in order to access the ordering and purchasing of our products.

Product Information

All information about the products that you can purchase through our online store can be found on our website.
We strive to provide the most accurate and detailed information about each individual product in our online store. VH reserves the right for errors in the description or photograph of a specific product, as well as the right to change information (including product prices and promotional offers) on the website without prior notice.

The product images displayed on the website are for illustrative purposes and may not always match the products that are the subject of your order in all details. Only products that are indicated as available and in stock can be the subject of an order. In the case of a high volume of orders, it may happen that the information about product availability does not correspond to the actual stock status.

Order and Purchase

If you, as a customer, decide to purchase a specific product in our online store, after familiarizing yourself with all the provisions of the General Terms and all information about the product, you select the product for purchase by clicking on the product or by clicking the “Add to Cart” option.
Before adding products to the cart, you can specify the products.
By adding all selected products to the cart, you can choose the “View Cart” option, which displays the entire content of your cart (all products you have selected for purchase). This option allows you to review your order, add or remove selected products, change the quantity of products, enter a discount code, and more. After reviewing and editing the contents of the cart, to save the desired changes and continue entering delivery and payment information – select the “Proceed to Checkout” option.

By providing your personal data, namely delivery information, and selecting a payment method and, if applicable, entering payment details to complete the order, you must click the “Order” option. At the moment VH receives the email confirming your order, it is considered that a purchase agreement for the product has been concluded between you as the buyer and VH as the seller. In the event that we are exceptionally unable to deliver any of the ordered products for any reason, we will contact you to arrange for the delivery of a replacement product or possibly cancel the ordered product. VH may reject the order (not deliver the goods) if it determines that prohibited behavior has occurred on the website or if it finds that the details on the order are incomplete and/or incorrect.

Prices

The prices of our products on the website are expressed in the official currency of the European Union (euro – EUR). All payments will be made in euros (EUR). The prices of our products on the website include all taxes and fees. The stated prices are subject to change, and any changes will be promptly recorded in the online store. VH is authorized to change product prices without prior notice.

Payment Methods

In our online store, you can make payments in the following ways:

Via the internet (cards): with credit and debit cards Mastercard, Visa, Discover, one-time payment, and PayPal. For credit and debit card payments, we use CorvusPay – an advanced system for secure online payment card acceptance. CorvusPay ensures complete confidentiality of your card details from the moment you enter them into the CorvusPay payment form.
E-banking: products are delivered only after your payment is visible in our account. Products are not delivered solely based on confirmation of your payment.

Delivery

Product delivery is possible within the European Union and is carried out to your address via a delivery service of our choice.
Our contractual partner for delivery is currently MBE Adriatic d.o.o. (hereinafter referred to as “MBE”). VH reserves the right to choose another delivery service if it will result in more efficient product delivery.
VH pays special attention to adequate packaging of products for transport to prevent damage or devaluation of products during transit.

Delivery is carried out on weekdays during working hours. The delivery time to the registered address within the Republic of Croatia is 5-7 working days. Exceptions may be islands and smaller places where delivery is not made every day. For islands covered by our partner’s delivery service, the product will be delivered according to a special schedule – you will be specifically notified about this, and for all other islands not covered by our partner’s delivery service, products are sent via Croatian Post.

For deliveries outside the territory of the Republic of Croatia, that is, in the European Union, the delivery time is 10 to 15 working days. Exceptions may be islands and smaller or remote places where delivery is not made every day. In the case of delivery to islands and smaller or more remote places, the product will be delivered according to a special schedule – you will be specifically notified about this.

Delivery speed may vary from the usual, for example, during holidays, non-working days, major sales events, and other situations where difficulties in shipping and delivery may occur.

The cost of delivery depends on the weight of the package. Prices are available in the following documents:

Delivery price list for the Republic of Croatia.

The delivery cost is always displayed separately and printed on the invoice.

COMPLAINTS AND RETURNS

As a customer, you are required to check for any damage when receiving the ordered product from the delivery person and to report it immediately to the delivery person who delivered the product. VH is not responsible for mechanical damage incurred during delivery.
If the product has a hidden defect that could not be detected during a usual inspection upon receipt, as a customer you have the right to one of the following:

unilateral termination of the contract and a refund,
replacement of the product,
removal of the defect,
price reduction.

In the event that you receive a product different from the one you ordered and purchased, you have the right to the delivery of the ordered product. If it is not possible to deliver the ordered product, you have the right to a refund equal to the amount of the paid price of the product and delivery, with the mandatory return of the incorrectly delivered product.
In case you do not pick up the ordered product or refuse to pick up the ordered product without a valid reason, VH reserves the right to claim compensation for logistics costs and other expenses.

Complaints

In accordance with the applicable regulations governing consumer protection rules, if you are a customer of our products via the website, you can submit a complaint related to the online purchase in person or via written correspondence to the address of our headquarters – Vukovarska 88, Rijeka, Croatia, or via email at: info@oromo.eu.

The seller will provide a response to the complaint within 15 (fifteen) days from the date of receipt of the complaint. The buyer is required to provide their contact details when submitting a complaint. Disputes related to online purchases within the territory of the European Union can also be resolved through the ODR platform (Online Dispute Resolution).

Unilateral termination

If you are a buyer of our products through the website, you have the right to unilaterally terminate the purchase contract for the product within 14 (fourteen) days from the day the product was delivered to you, or from the day of receipt of the product. You can provide a unilateral termination of the purchase contract for the product without stating a specific reason. The conditions for using the option of unilateral termination of the purchase contract for the product are as follows:

that the product has not been used,
that it is returned to the seller in the same condition in which it was received by the buyer, that is, that it is returned in its original packaging, along with the accompanying receipt and documentation.

If you wish to exercise your right to unilaterally terminate the purchase contract for the product, you can do so by filling out the unilateral termination form for the purchase contract for the product and submitting it in person or by mail to the address of our headquarters – Vukovarska 88, Rijeka, Croatia, or via email to: info@oromo.eu.
In the case of fulfillment of the conditions for unilateral termination of the product purchase contract, VH will refund you the monetary amounts, including delivery costs (if they were charged), but excluding the costs of returning the product. The refund will be made no later than 14 (fourteen) days from the day when VH receives the notice of unilateral termination of the product purchase contract. The refund will be made in the same manner as the payment was made.

FINAL PROVISIONS

These General Terms and Conditions are governed by the law of the Republic of Croatia and the law of the European Union, to the extent applicable, taking into account the membership of the Republic of Croatia in the European Union.
Any disputes arising from these General Terms and Conditions or their amendments will be attempted to be resolved amicably by VH and the user, and in case such resolution is not possible, the competent court in Zagreb will have jurisdiction.

If any provision of these General Terms and Conditions is wholly or partially invalid or becomes wholly or partially invalid, this does not affect the validity of the other provisions of the General Terms and Conditions or the General Terms and Conditions as a whole. Each invalid provision will be replaced by a reasonable provision that is permissible by law and closest to the business purpose of the original provision.
